Terms of Use

1. Acceptance of Terms

By accessing or using Manabit ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Manabit.

2. Service Description

Manabit is a web-based pixel art editor. The app is free to use; certain features are available only on paid plans.

3. Account Registration

An account is optional for free use but required for paid features. Accounts are created via Google OAuth or email magic link. You are responsible for maintaining the security of your account credentials. Each person may maintain one account.

4. Subscriptions and Payments

  • We offer different tiered plans; details and current prices are shown in the app before you subscribe.
  • Paid plans are available as yearly subscriptions (and other billing options we may offer from time to time).
  • Payments are processed by our payment provider (e.g. PayPal). Subscription charges and billing cycle are shown at checkout before you pay.
  • You may cancel or pause your subscription at any time from Account settings. Cancellation takes effect at the end of the current billing period.
  • No refunds are provided for partial billing periods.
  • We reserve the right to change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.

5. Digital products, sales final, and refunds

Due to the nature of digital products, all sales are final. We do not offer refunds for 'change of mind' once a download has started or a subscription has been accessed. This does not affect your statutory rights regarding faulty goods or services that do not match their description.

Outside those statutory rights, any refund or credit is solely at our discretion.

6. User Content and Intellectual Property

You retain full ownership of all content you create using Manabit, including projects, artwork, and palettes.

By using cloud features, you grant Manabit a limited, non-exclusive license to store, transmit, back up, and display your content solely as necessary to provide the Service (e.g., cloud sync and automatic backups). This license ends when you delete your content or account.

You are responsible for ensuring that your content does not infringe any third-party intellectual property rights.

7. Asset Store

The Asset Store offers free and paid assets (sprites, tiles, palettes, etc.) for download. Assets are provided under their respective license terms. You may use downloaded assets in your projects in accordance with those terms. Manabit is not responsible for the content or quality of third-party assets.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or to distribute illegal content.
  • Upload or distribute malware, viruses, or harmful code.
  • Attempt to reverse engineer, decompile, or scrape the Service.
  • Impersonate others or engage in harassment or abuse.
  • Interfere with or disrupt the Service or its infrastructure.

We reserve the right to suspend or terminate accounts that violate these terms.

9. Manabit Intellectual Property

The Manabit application, including its design, code, branding, and original assets, is owned by coldfox. You may not copy, modify, distribute, or create derivative works of the application itself without prior written permission.

10. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • Local-only projects are stored in your browser and are subject to browser storage limitations. We are not responsible for data loss from browser storage being cleared.
  • Cloud sync requires an active internet connection and an eligible paid subscription where applicable.

11. Limitation of Liability

To the maximum extent permitted by law, Manabit and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or service interruptions, arising from your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you have paid to us in the 12 months preceding the claim.

12. Termination

  • You may delete your account at any time from Account settings.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your cloud data will be deleted. Local data stored in your browser remains on your device.

13. Changes to These Terms

We may update these Terms of Use from time to time. Changes will be posted within the app. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts of the jurisdiction in which Manabit operates.
